Serie N° 79: ¿Permite el derecho de acceso a la información pública, el acceso a datos personales?

Abstract

This paper analyzes the data protection right in the comparative law, their rights and principles which distinguish from the right to privacy. Also analyzes the current situation of this right in Chile and its application in the public sector. Then, describes the freedom of information object and its relation with the habeas data right contained in the Law Nr. 19.628, analyzing the function given to the Transparency Council like a Service which guarantee the personal data in the Government, highlighting some issues that represent the use of freedom of information right to access to personal data.
